Mazin Property Promotions Limited (Referred to in this document as "Mazin Properties", "We", "Us") agree to provide to you the homeowner ("You", "Your") the services as described in this document subject to the terms and conditions of this document.
By displaying your property on Mazin Properties, you agree to the following terms and conditions
Our Service
Once you have paid the fee as set out on this website ("Site"), you may advertise your property details on the site.
You can only advertise the details of the property at the address submitted to us on this site. You may not change the actual address once submitted.
Our service includes
Tools and information to help you manage the content of your listing.
The forwarding of enquiries generated by your listing to your nominated email address.
A for sale' or 'to let' sign, (at an extra cost) delivered to your door but not erected for you.
Providing a medium for you to privately advertise your property.
You agree that in all other respects the responsibilities of selling or renting your property are yours
You are responsible for
Dealing with enquiries in relation to your Property
Deciding the price of the Property
Following up enquiries
Screening potential buyers
Handling viewings
Price Negotiation
Finding and Instructing a solicitor.
Use
You agree to use the Service strictly in accordance with these Terms and conditions. If you do not agree to these terms, please do not apply for this service.
Property Ownership
You confirm that:
You are the legal owner of the property and have the right and authority to sell the Property; or you legally represent the legal owner of the Property and are under their instruction and have the right and authority to sell the Property.
You are aged 18 years or over and are legally entitled to enter into and understand these Terms.
On payment of the fee you are entitled to publish the Property details on the Site.
Mazin Properties is a publishing medium helping you to privately advertise the Property for sale and that we are not acting as agent in respect of the Property.
Renewal, Duration & Removal of Your Property Advert
You are required to maintain your Property advertisement. It is your duty to ensure it is current and once your home is sold or rented you must inform us so that it may be removed from the site.
Your property will be displayed on Mazin Properties for 6 calendar months from the date you pay the fee.
If we are unable to contact you via the current e-mail address you provide on your advertisement, and it appears this e-mail is no longer functioning, we reserve the right to remove your property without accountability to us. If you do change your email address, please let us know.
You agree and understand that it is your responsibility to delete your advertisement as soon as the Property is no longer available for sale or rent.
If you contact us to request the deletion of the Property, we can only remove your property with proof that you are the original advertiser.
Advert Content
You confirm and guarantee that the details, description, information and any images submitted for publication by Mazin Properties on the Site are true and accurate and contain no false statements, misrepresentations or omissions which may mislead any interested parties over the condition, location and availability of the Property or your lawful right to sell it.
You agree that you are solely responsible for the content and truthfulness of any advert that you post on the Site.
You agree that Mazin Properties is in no way responsible for any losses or damages however arising, including claims from third parties, that may result from any advertisements that you post on the Site.
We reserve the right to defer or remove (at our discretion) the publication of your advertisement on the Site in the event that we are made aware by whatever means that the content is unfitting , deceptive or incorrect , without liability to you. In such circumstance we will notify you of the suspension or termination by email or letter as soon as the advertisement is removed/deferred.
Any adverts giving rise to complaint or dispute of any kind shall be deferred pending enquiry or otherwise removed. Mazin Properties can in its sole discretion relist the advertisement upon receipt of satisfactory proof that such a dispute or complaint has been resolved. In no event shall Mazin Properties be required to act in respect of any dispute or complaint other than to defer or remove the listing.
Listings which contravene any law or regulation containing bad or otherwise inappropriate language, insult or violate the rights of any third party (including intellectual property rights) will be terminated immediately, without warning or liability to us.
Cancellation
Should you place a listing and change your mind for any reason before you have paid, please contact us and we will remove your advertisement from our database. You will not be charged. You may cancel an advert within 7 days once you have paid by contacting us .
Your Contact Details
You comprehend that it is essential to provide a working and correctly submitted e-mail address in order to receive any queries from interested parties and communications from Mazin Properties.
You are solely responsible for checking that your contact details on your listing are correct and kept up-to-date at all times to ensure enquiries can reach you.
We cannot be held responsible for any e-mail problems you experience, whether a result of your Internet Service Provider, the Internet or any other technical issue.
You agree that Mazin Properties gives you the option to display your for sale sign (at an extra cost). You understand that by displaying these details you may get interested parties calling at your house in person. If you have a concern about security, we recommend you place a note in a visible place asking interested parties to leave a telephone number so you can contact them to arrange a viewing or do not have a sign.
Dual Advertising - Your Responsibility
You accept and agree that you are solely responsible for managing all relationships (if any) you have with other property agents in respect of the Property and are liable for all fees or other payments due to such agents
Refund Policy
Your advert will be made live within 24 hours of payment, and submission of property details on the site.
No refunds will be offered for temporary or permanent loss of Service however arising, including a loss of Service due to the Mazin Properties website being unavailable for any reason.
This does not affect your statutory rights as a consumer.
In no event will Mazin Properties be liable to you whether by way of a refund or in any other respect in the event that Mazin Properties ceases to trade for whatever reason.
The total liability of Mazin Properties to you, however arising under these Terms in respect of the Service, shall be limited (to the extent permitted by law) the total Fee paid by you for the Service.
Copyright
By submitting the Property to Mazin Properties you confirm that you own the copyright in details, including photographs, that you submit and allow us a licence to use the Property details to provide the Service and for publicity when promoting the Site and the Property.
Data Protection
Mazin Properties respects your privacy and will manage your personal details securely. We will not disclose your address on our website and all queries will reach you via our secure messaging system. More information is available on our Privacy Policy.
Miscellaneous
You understand that Mazin Properties cannot guarantee a buyer (properties for sale) or tenant (rental properties) as a result of listing the Property on this site nor can Mazin Properties guarantee enquiries or the legitimacy of enquiries.
Mazin Properties reserves the right to ultimate discretion as to which adverts, if any, are in breach of these terms. Mazin Properties reserves the right to amend these terms at any point and without notification.
These Terms represent the entire agreement between Mazin Properties and you and all contracts and representations are permitted by law.
These Terms shall be governed by the laws of England and Wales and the parties yield to the exclusive jurisdiction of the English Courts.
